Relief as Supreme Court indefinitely extends Aadhaar's mandatory linkage

The delivery subsidies and benefits would still require Aadhaar, as provided under section 7 of the Aadhaar Ac, 2016. The top court is hearing petitions challenging the Constitutional validity of the Aadhaar Act. At present the deadline for mandatory linking of Aadhaar to avail these benefits is March 31.

On 7 March, the Supreme Court directed the CBSE not to make Aadhaar number mandatory for enrolment of students appearing in NEET 2018 and other all India exams.

There's a good news for those who were fretting over linking their Aadhaar number with their bank or mobile numbers.

"...we direct that the interim order passed on 15.12.2017 shall stand extended till the matter is finally heard and the judgment is pronounced", the Court ordered.

Though today's order applies for mobile numbers, tatkal passports, and bank accounts, people still have to connect their Aadhaar numbers with welfare schemes like Pradhan Mantri Ujjwala Yojana, Mid-day Meal Scheme, Mahatma Gandhi National Rural Employment Guarantee Act, 2005, among others.

There's no new deadline to connect these services with the 12-digit Aadhaar number. Now the Constitution bench has clearly said the deadline will be decided only after the court passes its final judgment on linking the Aadhaar to various services.

A group of petitioners have asked the Supreme Court to declare the government's insistence on Aadhaar disclosure as a violation of the right to privacy.

Over the last two weeks, mobile phone cellular service providers and banks have been messaging its clients to link one's Aadhaar to their account or mobile phone.

This effectively means that the order will not apply in cases where subsidies are given by the government. The court granted this in response to a request made by attorney general K.K. Venugopal.
