McCabe could be fired before Federal Bureau of Investigation retirement

Deputy FBI Director Andrew McCabe has been a public and private target of President Trump and Attorney General Jeff Sessions for his role in both the investigation into possible connections between the Trump campaign and Russian Federation, as well as his status as a witness in a potential case of obstruction against the president.

Sessions is reviewing a recommendation from the FBI's Office of Professional Responsibility that McCabe should be fired immediately for misleading Justice Department officials, said the person who asked not to be identified discussing the sensitive deliberations.

President Trump has frequently slammed McCabe, seeing him as biased against his administration and in the tank for Hillary Clinton during the campaign.

"The Department follows a prescribed process by which an employee may be terminated", a Justice Department spokeswoman said Wednesday.

McCabe stepped down from his post as the FBI's second-in-command in January after Trump repeatedly accused him of political bias, but remained on the payrolls in order to qualify for full retirement benefits. That yet-to-be-released report triggered an F.B.I. disciplinary process that recommended his termination - leaving Mr. Sessions to either accept or reverse that decision. For more than a year, the Justice Department's inspector general has been looking into whether McCabe should have done more to shield certain investigations from potential conflicts of interest, and the inspector general's office recently completed a draft report on McCabe. "We have no personnel announcements at this time", she added. In October 2013, McCabe took over the FBI's entire national security branch, and the next year he moved to become the Assistant Director in Charge of the FBI's Washington Field Office.

In 2016, McCabe evidently authorized a top aide and the FBI's chief spokesman to speak with a Wall Street Journal reporter for a story indicating that McCabe battled with Obama appointees within the Justice Department to allow an FBI investigation into the Clinton Foundation to continue.

It would be another historic moment for the White House, as no deputy director in the history of the Federal Bureau of Investigation has ever been fired.

Now, Mr. Sessions is the final arbiter of Mr. McCabe's dismissal, shortly before his retirement takes effect Sunday.
