Johnson & Johnson ordered to pay £3.5 billion in damages over'cancer-causing talc

The state court jury, in Missouri's 22nd Judicial Circuit, deliberated for 8 hours before concluding Thursday that asbestos in the J&J products caused the women's ovarian cancer and awarding $550 million in compensatory damages on the claims.

The plaintiff's lawyers said asbestos fibers were found in the ovarian tissues of numerous women and introduced evidence that explained how asbestos is intermingled with the mineral talc - the primary ingredient in Johnson's "Baby Powder" and "Shower to Shower" products.

In a statement, Johnson & Johnson said it is "deeply disappointed in the verdict" and it plans to "pursue all available appellate remedies".

"Your voice is not just the voice of the community but the voice of the world", Lanier said.

"If there were a link, any increase in risk would be fairly small, and as ovarian cancer is a relatively rare disease, overall women who use talc would still have a low chance of developing the disease". The company said plaintiffs' tests showing asbestos contamination were "junk science". Mr Lanier said at the trial that flawed testing methods which did not allow for the proper detection of asbestos had been used.

A previous ruling in 2017 by a California jury awarded $417m but that was later overturned on appeal.

The US Food and Drug Administration (FDA) commissioned a study of a variety of talc samples, including Johnson & Johnson, from 2009 to 2010.

One juror, Evan Klene, 24, a financial analyst, said the jury tried "to understand the totality of what these women went through".

In other appeals, J&J convinced judges to toss verdicts worth $72 million and $55 million; appeals on the other cases are pending. Six of them have already died from ovarian cancer. Another mesothelioma case in late May ended in a mistrial. Cramer, who at one point advised J&J to put a warning on its products, has become a frequent expert witness for women suing the company.

Lawyers for the plaintiffs said punitive damage awards are limited by state law to five times the amount of compensatory damages awarded and defense lawyers probably would file a motion to reduce the award.

The company now faces about 9,000 talc-cancer cases in state and federal court, according to published reports, with the bulk of state court cases in Missouri, New Jersey, and California, according to J&J's May 2018 quarterly report.

Scientists know this because they cannot only see that people infected with the virus are more likely to develop cancer, but they can also find specific damage caused by the virus in tumors.

And Judge Vince Chhabria of U.S. District Court in San Francisco, who ruled that plaintiffs could present evidence about cancer in their Monsanto lawsuit, said he thought that the evidence was "rather weak" and that it would be a "daunting challenge" to persuade him to let a jury consider whether the weed killer caused any individual's cancer.
