He can file an appeal by November 9. He's now serving a more than 3-year sentence for fraud and failing to pay taxes.

The Real Housewives of New Jersey's Joe Giudice will not be allowed to stay in America once he gets out of prison.

Sources close to the reality star said that Giudice is still holding out hope for the appeal, but things are not looking good right now. He's incarcerated at FCI Allenwood, about 165 miles northwest of Philadelphia. He is set to be released next year.

The couple pleaded guilty in 2014 to bankruptcy fraud and submitting false loan applications to get $5 million in mortgages and construction loans.

A judge ruled on October 10 that Joe Giudice must be deported to his native country of Italy, according to Radar Online. Teresa served 11 months at FCI Danbury in 2015 and Joe is now serving a 41-month prison sentence at FCI Allenwood in Pennsylvania.

Messages were left with his and his wife's lawyers.
