Activists across the Bay Area Thursday evening were protesting President Donald Trump's replacement of his attorney general after embattled former Attorney General Jeff Sessions resigned on Wednesday.

"Whitaker has to recuse himself under DOJ's regulation requiring recusal if you have a personal or political relationship with someone substantially involved in conduct that is the subject of the investigation or prosecution", Shaub told Reuters.

"It is ORDERED by the Court on its own motion that each party submit a supplemental brief addressing what, if any, effect the November 7, 2018 designation of an acting Attorney General different from the official who appointed Special Counsel Mueller has on this case", the order says, giving the parties a deadline of Nov. 19.

In announcing the resignation in a tweet that thanked the former Alabama senator "for his service" - Trump right away named as acting attorney general Sessions' chief of staff Matthew Whitaker.

The Associated Press reported that former Attorney General Jeff Sessions was forced out of office Wednesday, based on a letter from Sessions that mentions Trump's request that he resign.

New York Democrat Jerrold Nadler, the incoming chairman of the House Judiciary Committee, said it was "way too early" to discuss that step.

West Wing sources said they are "worried" about Trump Jr as they fear Mueller will be able to snare him on perjury.

Sam Clovis, who was co-chair of Trump's 2016 campaign and has testified before the grand jury in the Mueller investigation, said he and Whitaker became good friends when they ran against each other as Republicans in a 2014 Senate primary campaign in Iowa.

"I'm confident the White House is looking for someone who the president and country can have confidence in, and be confirmed by the Senate", Graham said in a statement.

"His most brazen act of obstruction has taken place in the last 24 hours", Clements said. "Mueller has come up to a red line in the Russian Federation 2016 election-meddling investigation that he is dangerously close to crossing", he thundered.

Trump told associates that he felt that Whitaker would be "loyal" and would not have recused himself from the Russian Federation probe as Sessions had done, according to two Republicans close to the White House not authorized to speak publicly about private conversations. Trump, who denies any collusion, has long complained about the probe, calling it a witch-hunt. They also said they will continue to conduct parallel investigations alongside special counsel Robert Mueller's probe, and urging them to preserve all relevant documents. A Justice Department spokeswoman declined to comment.

Whitaker, speaking on CNN in 2017, said he had respect for Mueller and then went on to say he would be surprised if the special counsel had any concerns about the termination of Sessions and its effect on the investigation. According to the department's most recent report, $10 million was spent from October 1, 2017, through March 31.

"If the president seeks to interfere in the impartial administration of justice, the Congress must stop him", Adam Schiff said.

Sen. Angus King said Thursday that Congress should pass legislation to protect the Mueller probe.
