McGahn told Trump that even requesting a DOJ investigation, something within his power, would likely draw howls of protest and accusations that he was abusing his power, according to the Times.

Mr McGahn's lawyer William Burck said: "Mr McGahn will not comment on his legal advice to the president".

"Like any client, the president is entitled to confidentiality".

A lawyer for McGahn told the Times that Trump "never, to his knowledge, ordered that anyone prosecute Hillary Clinton or James Comey".

It was not clear what laws Trump believes Clinton or Comey allegedly broke.

McGahn "rebuffed the president", the Times reported, saying he lacked the authority to order prosecutions.

The president named Pat Cipollone as his replacement, but the noted commercial lawyer and conservative Catholic activist has not been seen at the White House.

Democrats have opposed this action due to previous comments by Mr Whitaker that criticised Robert Mueller and his investigation.

Dean-who was sacked by Nixon during the Watergate scandal, plead guilty to obstruction of justice over his involvement and later become a key witness for the prosecution-told Berman: "If I had to channel a little of Richard Nixon, I think he'd tell this president he's going too far".
