A Sri Lankan court has stayed disputed Prime Minister Mahinda Rajapaksa and his ministers from holding their positions as it hears an appeal against them.

"We do not agree with the decision given by the Appeals Court as Constitutional matters are finally decided by the Supreme Court", Rajapaksa said on Twitter.

Rajapaksa said he will take his appeal to the Supreme Court on Tuesday and seek an order halting the decision.

Ousted prime minister Ranil Wickremesinghe said 29 October that his controversial sacking has left Sri Lanka in a power vacuum and demanded that parliament be allowed to end a standoff with the president.

The petitioners sought an order in the nature of Quo Warranto declaring that 49 respondents including the Prime Minister and the Ministers of the incumbent government are not entitled to hold the office of ministers of the cabinet of Ministers and Deputy Ministers.

President Maithripala Sirisena sacked Wickremesinghe and replaced him with Mahinda Rajapakse, the larger-than-life former president credited with ending Sri Lanka's bloody civil war with Tamil separatists in 2009.

Sirisena later dissolved Parliament, nearly 20 months before its term was to end, and ordered snap election.

The political crisis has crippled the government for more than a month.

Mr. Rajapaksa has, so far, failed to prove his majority in Parliament.

Sirisena, a former opponent of Rajapakse, told a group of legislators on Monday that he would not reinstate Wickremesinghe even if the latter had the support of all 225 members of the legislature.

Wickremesinghe, with the support from the main Tamil party, claims to have the support of more than 113 legislators, required for simple majority.

The UNF has moved three no trust motions against Rajapaksa, who has refused to step down.

The court intervened and restored parliament in November when Sirisena - seeking to stave off a challenge to his new appointee - suspended the legislature.
